These Terms & Conditions ("Terms") govern your use of Morphonic, a personalized sound therapy application operated by Boundless Creations ("we", "us", or "our"). By creating an account or using the service, you agree to these Terms.

1. The Service

Morphonic is a wellness application that generates personalized binaural beat audio sessions using AI, paired with visual modes and guided breathing exercises. Sessions are generated based on your described emotional state and desired feeling.

Not medical advice. Morphonic is a wellness tool — it is not a medical device, does not provide medical advice, and is not a substitute for professional mental health care. If you have a medical condition, consult a qualified healthcare provider before use.

Photosensitivity notice. The visual modes contain moving patterns and flashing elements. If you have photosensitive epilepsy or are sensitive to flashing lights, use the audio-only mode.

2. Your Account

• You must provide a valid email address to create an account
• You are responsible for maintaining the security of your account
• You must be at least 13 years old to use the service
• One account per person — accounts are not transferable

3. Session Generation Limits

Free accounts can generate up to 3 new sessions per rolling 7-day period. This limit exists to manage AI generation costs and encourage deliberate use. Replaying existing sessions from your history does not count against this limit.

4. Email Communications

If you opt in during onboarding or in Settings, we will send you a daily email with your active session at your chosen time. You can opt out at any time via the unsubscribe link in any email or through the Settings page. Transactional emails (magic link sign-in) cannot be opted out of as they are required for account access.

5. Acceptable Use

You agree not to:

• Attempt to circumvent session generation limits or access restrictions
• Use the service in any way that could harm other users or the service
• Reverse engineer or attempt to extract AI models or proprietary systems
• Use the service for any unlawful purpose

6. Intellectual Property

The Morphonic name, logo, design system, and application code are owned by Boundless Creations. Session content generated for you (audio parameters, rationale) is yours to use for personal wellness purposes. You may not redistribute or commercialize generated session content.

7. Disclaimer of Warranties

Morphonic is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or that any particular session will achieve your desired mental state. AI-generated content may vary in quality.

8. Limitation of Liability

To the maximum extent permitted by law, Boundless Creations shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Morphonic. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (which, for free-tier users, is zero).

9. Termination

You may delete your account at any time from the Settings page. We reserve the right to suspend or terminate accounts that violate these Terms. On termination, your data will be deleted in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms as the service evolves. Continued use of Morphonic after changes constitutes acceptance. Material changes will be communicated via email.

11. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.
